Attorneys have found that a man mentioned in Reservation Counter's lawsuit against Expedia was not involved in a company that allegedly received stolen data.

The lawsuit, filed last year in U.S. District Court in Ohio, alleges that Expedia stole data from online travel agency Reservation Counter, and an Expedia employee leaked that data to employees of Roomstays.com and later Reservations.com.

One of the employees who allegedly received the data was Sherman Distin, but a letter from TravelPass' lawyer, Andrew Hansbrough, states that Distin did not work for Reservations.com. Hansbrough confirmed the letter's authenticity. Distin was never named as a party in the lawsuit.

"Upon further investigation and review, TravelPass believes that Sherman Distin never worked for or had any relationship with Reservations.com," Hansbrough wrote in a May 10 letter to Distin. "This letter confirms that belief."

In an email, Hansbrough said the lawsuit "is now in confidential arbitration," and declined further comment.
